EASTHAM DISTRICT OF CRITICAL PLANNING CONCERN
AMENDMENT TO THE EASTHAM CORRIDOR SPECIAL DISTRICT IMPLEMENTING REGULATIONS (DCPC-17021)
October 4, 2018
The Cape Cod Commission (Commission) will conduct a public hearing on Thursday, October 4, 2018 at 3:00 p.m., in the Innovation Room/Open Cape Building, Barnstable County Complex, 3195 Main Street, Barnstable, MA to consider, pursuant to Sections 10 and 11 of the Cape Cod Commission Act, whether amendments to the Eastham Corridor Special District(“ECSD” and “Implementing Regulations”) of the Eastham District of Critical Planning Concern (DCPC) conform to the guidelines of the Cape Cod Commission issued in the CCC decision on the (DCPC) designation on October 12, 2017. The original implementing regulations were adopted by the Assembly of Delegates by Barnstable County Ordinance 17-12 on November 1, 2017 and were adopted on May 7, 2018 at Eastham Town Meeting. The following is a summary of the Proposed zoning amendments:
Section E. Definitions: clarification to the definition of Frontage Building.
Section F. 1 ECSD Use Regulations, Allowed Uses table: Correction to reflect Planning Board’s vote to not allow apartments above commercial use in Tradesmen’s Park district.
Section F.3 Change Alteration, Expansion of Non-Conforming Structures and Uses:
• language inserted to clarify when changes to site area or building exterior will trigger review;
• Language inserted to clarify that changes/alterations to pre-existing, non-conforming uses and structures that do not qualify for Minor Site Plan Review may apply for Major Site Plan Review;
• Changed landscape “buffer” requirement to landscaped “area.”
• Under 3.b. Major Site Plan Review, added a reduction in the landscape area requirement for pre-existing non-conforming sites where the building is within 30 feet of the road right of way.
Section G. ECSD District Wide Development Standards: language inserted to allow for an exemption to Parking Setback requirement; minor changes to landscaping standards; inserted curb cut width standard; inserted of language to allow for an exemption to Route 6 access limitation; added residential parking standards.
Section H. ECSD Review Procedures:
• Changed language in table consistent with clarifications added to Section F.3.
• Inserted criteria for Major Site Plan Approval and Site Plan Special Permit Approval that requires determination by the Planning Board that all ECSD district wide standards are met.
This notice is being published as required by Section 5 of the Cape Cod Commission Act.
The area of the Eastham District of Critical Planning Concern and its boundaries encompass commercially zoned land in the Town of Eastham, including District C Industrial, District D Retail Sales and Service, and District E Residential/Limited Commercial, and all land within the North Eastham Overlay District bounded on the north by the Eastham/Wellfleet Town boundary, to the south by Old Orchard Road, to the east by the Cape Cod Rail Trail, and to the west by Herring Brook Road and Massasoit Road. The district consists of approximately 280 acres of land area and approximately 2.9 acres of open water.
